Cavalleri, who had already spent significant sums at Hermès, claims she was coerced into purchasing additional items to obtain another Birkin bag, while Glinoga alleges he was informed by a sales associate that he needed to buy other items before being considered for a Birkin bag.

The lawsuit asserts that Hermès’ actions violate antitrust laws by exploiting its market power to artificially increase the price and demand for Birkin bags.

Seeking class-action status, the plaintiffs aim to represent all U.S. residents affected by Hermès’ tying practices over the past four years, seeking monetary damages and a court order to cease the alleged illegal practices.
